Terms of service

What you can expect from us, what we expect from you, and — the important part at this stage — what a device reservation is and is not.

Read this first

gemnotes is a prelaunch project. There is no incorporated legal entity behind it yet, no product is sold, and no payment is accepted. These terms describe how we intend to behave and are written to be read, not to be hidden behind. They have not been reviewed by a lawyer and are not a substitute for a contract with a company.

When an entity exists and something is actually for sale, this page is replaced by reviewed terms and the date at the top changes. Nothing here takes away rights you have under the law where you live.

1. What these cover

This website at gemnotes.me, the forms on it, and the gemnotes software if and when you install it. If you use any of them, these terms apply. If you disagree with them, don't.

2. The device reservation — the part that matters

Stated as plainly as we can:

If a real sale ever happens it will be under separate terms you'll be asked to accept at that point, with consumer rights, warranty and returns spelled out properly.

3. The software

The gemnotes applications run on your own hardware and store your notes on your own disk. Practical consequences worth being explicit about:

4. What we ask of you

5. Accuracy of this site

We try hard to keep every claim here true, dated and traceable — that is what the status page is for. Measurements are stated with the hardware and date they were taken on. Where we don't have a number, we say we don't have one rather than estimating.

If you find something on this site that is wrong, tell us and we'll correct it publicly. Figures about other companies come from their own published reports and from independent reviews.

6. Certifications

We hold no security certifications and claim none. Any status shown on the security page is exactly what it says, including “not started”. Do not treat anything on this site as evidence of compliance with any standard.

7. Liability

Nothing is sold, nothing is paid and nothing is warranted, so our liability at this stage is limited to the fullest extent the law where you live allows. We do not limit liability for fraud, or for anything that cannot lawfully be limited.

8. Privacy

Covered separately and in more detail in the privacy policy, which forms part of these terms.

9. Changes

These terms can change. Material changes — especially anything affecting a reservation you hold — will be emailed to you, not quietly edited in. The date at the top is the version marker.
